Article 1 (Application)
These Terms apply to all relationships between the user and the Developer regarding the use of the App. The Developer may establish additional rules, notices, or conditions for the App, and such rules shall form part of these Terms.
Article 2 (Description of the App)
The App is a language-practice app that lets AI place random incoming calls within time windows allowed by the user, and, when the user answers, supports real-time voice conversation with AI.
The App is provided for language practice and conversation opportunities. It is not a telephone network service, emergency calling service, medical, legal, financial, psychological, professional advice, official education assessment, or other service requiring guaranteed accuracy or availability.
Article 3 (Random Calls and Call Limits)
- Call times may vary depending on the days and time windows allowed by the user, device state, network conditions, server processing, Apple Push Notification service, and other circumstances. The Developer does not guarantee calls at specific times.
- Users may choose whether to answer a call. However, plan call limits are generally consumed based on call delivery, and may be consumed even if the user does not answer or the call does not become an active conversation.
- Calls may be delayed, fail, or not appear due to network issues, operating system restrictions, notification settings, Focus mode, power state, signal conditions, server failures, or third-party service failures.
Article 4 (AI Output and User Responsibility)
- AI speech, transcripts, summaries, learning notes, and profile extraction may contain errors, inaccuracies, inappropriate content, incomplete information, or content different from the user's intent.
- Users shall use AI output at their own responsibility and shall not rely on AI output for important decisions, professional advice, emergency response, health, medical, legal, financial, or other high-impact purposes.
- For AI voice conversations, transcription, summaries, profile extraction, and related features, the App may, based on the user's explicit permission, send call audio, conversation content, transcripts, prompts, AI responses, profiles, conversation settings, related metadata, and similar information to third-party AI services such as Firebase AI Logic / Vertex AI Gemini API (Google LLC) for processing.
- Users may decline or revoke permission to send personal data to third-party AI services. In that case, some features such as AI voice conversations, transcription, summaries, profile extraction, and conversation personalization may be unavailable.
- Users are responsible for the content they enter or speak during conversations and shall take care not to infringe third-party rights, privacy, or confidential information.
Article 5 (Accounts and Authentication)
The App may provide anonymous sign-in, Apple sign-in, Google sign-in, or other authentication methods. Users are responsible for managing their accounts and authentication credentials. If an anonymous account is deleted, lost, or not linked to another sign-in provider, related data or purchase-linked benefits may become unavailable.
Article 6 (Free Period, Paid Features, and Subscriptions)
- The App may provide a limited free usage allowance. The free period, call count, call duration, and eligible features may be changed by the Developer or through Remote Config or similar mechanisms.
- After the free period ends, or to continue using the App beyond the free allowance, a paid auto-renewable subscription may be required.
- The subscription content, price, billing period, availability of free trials or offers, and renewal conditions are as displayed on the purchase screen or in the App Store.
- Subscriptions automatically renew at the end of each billing period unless canceled by the user. Users should cancel or manage subscriptions through the App Store or Apple ID subscription management screen.
- Purchases, billing, renewals, cancellation, and refunds are processed by Apple through the App Store and are also subject to Apple's terms and policies. Unless required by applicable law or Apple's policies, refunds are handled by Apple and not directly by the Developer.
- Purchase status may take time to be reflected. Paid features may be temporarily unavailable due to network issues, App Store status, server processing, verification failures, or other reasons.
Article 7 (Data Storage, Data Loss, and Deletion)
- The App uses temporary storage, in-memory storage, local device storage, and cloud services depending on the feature.
- The Developer's policy is not to store call audio itself, but the App may store transcripts, conversation summaries, learning notes, profiles, call metadata, purchase entitlement information, and related data.
- Temporary data, cached data, in-memory data, unsaved data, and in-progress call data may be deleted or lost when the App is closed, the device restarts, the user logs out, the account is deleted, the App is updated or uninstalled, or the operating system cleans up storage.
- Users are responsible for preserving important information outside the App when needed.
- The Developer shall not be liable for any loss, corruption, deletion, inability to restore, or leakage of data except where required by applicable law.
Article 8 (Prohibited Acts)
Users shall not engage in any of the following acts when using the App:
- Acts that violate laws, regulations, or public order and morals
- Acts that infringe upon the rights, interests, privacy, reputation, or confidential information of other users, third parties, or the Developer
- Acts of entering, disclosing, or sharing another person's personal information, conversation content, audio, transcripts, or summaries without consent
- Acts of impersonating another person
- Acts that interfere with operation of the App or access systems without authorization
- Acts of reverse engineering, decompiling, modifying, or redistributing the App except where permitted by law
- Acts of using the App for unlawful surveillance, harassment, discrimination, fraud, encouragement of self-harm or harm to others, sexual exploitation, or other harmful purposes
- Acts of attempting to bypass safety measures, usage limits, or billing controls of the App, AI services, or third-party services
- Any other acts deemed inappropriate by the Developer
Article 9 (Suspension, Change, or Termination of the App)
The Developer may change, suspend, restrict, or terminate all or part of the App without prior notice due to maintenance, updates, technical issues, operational reasons, legal requirements, changes to third-party services, changes to AI models or Firebase AI Logic, or other circumstances. The Developer shall not be liable for damages resulting from such actions except where required by applicable law.
Article 10 (Intellectual Property Rights)
All copyrights, trademarks, and other intellectual property rights related to the App belong to the Developer or other rightful owners. Rights to conversation content, transcripts, profiles, and other content entered by users belong to the user or rightful owner, but users grant the Developer the rights necessary to provide, operate, maintain, and improve the App and related services.
Article 11 (Privacy)
The Developer handles user information in accordance with the Privacy Policy, which is available within the App or on the official website.
Article 12 (Disclaimer)
- The Developer provides the App as is and does not guarantee uninterrupted operation, error-free behavior, compatibility with all devices, availability of all features, successful incoming calls, or successful AI responses.
- The Developer does not guarantee the accuracy, completeness, usefulness, suitability for a particular purpose, or learning outcome of AI output.
- The Developer shall not be responsible for disputes or damages arising between users or between a user and a third party.
- The Developer shall not be liable for damages arising from use or inability to use the App, AI output, failed calls, failed conversations, data loss, network failures, device failures, delayed purchase status reflection, or third-party services except where required by applicable law.
Article 13 (Revisions to These Terms)
The Developer may revise these Terms as necessary. Any revisions shall become effective when posted within the App or on the official website, unless otherwise specified.
Article 14 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising from or related to the App shall be subject to the exclusive jurisdiction of the Japanese court with jurisdiction over the Developer's location.
